Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck or crushed resulting
from the
increased likelihood of a catastrophic failure of an inadequately
constructed and maintained in
ground automotive lift::
(a)Automotive service area, bay three, in-ground automotive lift:  On or
about
January 13, 2004, and at times prior thereto, employee(s) performed
automotive repair activities including but not limited to break jobs, oil
changes, and lift kit installations. Conditions noted at the time of the
inspection, which contributed to this hazard included:
(1)The in-ground automotive lift did not have an automatic mechanical
device
having a safety factor of 3 based on the rated load capacity.
(2)The lift was not marked with its rated load capacity.
(3)The lift operating instructions were not displayed in a conspicuous
location in
the lift control area.
(4)Periodic inspections and maintenance to ensure that all components are
in safe
operating conditions were not conducted. Under a load the in-ground lift
would
unexpectedly lower two to four inches.
(5)The employer failed to provide four high reach fixed stands to
equalized and
support the load. (Note: high reach fixed stands must be able to support
twice
the weight capacity of the lift).
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to replace the in-ground lift with a lift equipped with a
automatic mechanical
safety device, establish, implement, and enforce and effective program for
inspecting
and maintaining the required mechanical integrity of the automotive lift.
