Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of not wearing seatbelts while operating powered industrial trucks: (A)Job Site: On March 24, 2004, and at times prior thereto, employees operated a Hyster, equipment number 205-7-41F, model H50XM, serial number D177B16628C, powered industrial trucks without wearing seat belts. AMONGST OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REQUIRE THE USE OF SEAT BELTS WHEN OPERATING FORKLIFTS (POWERED INDUSTRIAL TRUCKS) THROUGHOUT THE ESTABLISHMENT AS REQUIRED BY ANSI/AMSE B56.1, PARAGRAPH 5.3.19. Note: Abatement certification required for this item.
