Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards of trucks which were not properly
maintained and
could result in accidents in the yard:
a) Ottawa Commando 30 Truck #YT0025 - The rear hazard light(driver side)
and
head light (passenger side) were not functional.  There was a hydraulic
leak on the
return hose to tank, and the rear brake lights were covered with mud.
b) Ottawa  Commando 30 #T0024 - There was a hydraulic leak on the return
hose to
tank.  The front hazard lights did not work and the rear brake lights were
covered
with mud.
c) Welding truck #02 - This truck was missing a gas cap and seat belt.
Truck was
operated with a flat tire on the passenger side.
Among other methods, one feasible and acceptable abatement method to
correct these hazards
is to maintain and enforce a more effective vehicle maintenance program
which will reduce
the likelihood of serious mechanical and other defects.
Abatement certification required within 10 days after abatement date.
The certification
shall include a statement that abatement is complete, date and method of
abatement,
and states employees and their representatives were informed of this
abatement.tives
