Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and place of employment which were free from recognized
hazards
that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the condition(s) listed below:
South side of the building at the jobsite;  On September 24, 2003, four
(4) employees were
unloading bricks and working with a mortar bucket on a second level of an
unprotected side
and end of a scaffolding approximately 15 feet to the ground level.  There
were at least five
(5) or six (6) other employees laying bricks on the first level of the
scaffolding.  In addition
to the employees, a supply of bricks and two (2) mortar buckets were on
the scaffolding.
The foreman had allowed the employees to work on the scaffolding, despite
a red tag
attached to the scaffolding reading "DO NOT USE scaffold not complete".
This exposes
employees to the hazard of falling off the scaffold and/or being struck by
bricks and other
materials and tools if the scaffold collapsed.
A feasible and acceptable abatement method to correct this hazard would be
to ensure
employee(s) was not allowed to work on the scaffolding and materials not
be loaded on the
scaffolding until it has been completely built and secured.ly
