Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being struck by the bucket of excavator. (a)Olive Branch, MS, Craft Road - Employees on September 23, 2004 were working in a 24 foot trench box directing the placement of the excavator's bucket. Employees were exposed to being struck by the excavator bucket. Amoung other methods, one feasabile and acceptable means of abatement would be to follow the guidelines in the Komatsu operator manual by preventing the excavator bucket from being pass over the head of workers.
