Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being run over by rear-loading refuse collection vehicle: (a)On or about March 26, 2004, at N.Sioux Avenue, Independence, MO, a helper fell off the back of a rear-loading refuse collection vehicle and was run over by the rear tires of the vehicle as the driver was backing down the street. The employer did not ensure that employees were prohibited from riding on steps or the loading sill while the vehicle was operating in reverse, per ANSI Z245.1-1999 Section 6.2.5.4. While ultimate responsibility for correcting the hazard rests with the employer, feasible and acceptable methods to correct these hazards, among others include: (1)Per Section 6.1.4.1 of the ANSI Z245.1-1999 Standard for Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment Safety Requirements, monitor the employee's activities and take appropriate action to ensure adherence to safe practices and the employee requirements of the ANSI Z245.1-1999 standard. (2)Per Section 7.2.11.6 of the ANSI Z245.1-1999 Standard and Section 2 of the Leach Refuse Equipment 2R Packmaster Service Manual, affix the required warning signs/decals on all refuse collection vehicles equipped with riding steps. Abatement Note: Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
