NCGS 95-129(1): the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hoists/cranes that had ot been load tested: a) battery charging area -- the C & H, 1-ton hoist/crane, had not been load tested. b) garage -- two jib cranes, manufacturer could not be determined, one was 1-ton and one was 2-ton, had not been load tested. c) feed mill -- the Ladesta electric hoist, 400 lb. capacity, had not been load tested. Among other methods, one feasible and acceptable abatement method to correct this hazard is to have all of the hoists and cranes load tested and maintain a certificate of the load test.
