Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that the
employees were exposed to the hazard of falling from an elevation while
working from a
wooden pallet raised on the forks of a powered industrial truck:
a.  Sears Hardware #5181 work place.  On or about December 15th, 2003
employees were required to work from a pallet type platform to retrieve
items
from the top of shelving racks.  The platform was not secured to the forks
of the
powered industrial truck and there was no fall protection provided for the
employees exposing them to a fall hazard.
