Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards of up to 18 feet and amputations associated
with working from an
elevated platform:
Big Joe high lift:
1.  There were no guardrails surrounding the outer perimeter of the
platform;
2.  A personal fall arrest system was not used by employees when
working from the elevated platform;
3.  There was no accommodation made to secure the platform to the
forks;
4.  Safety information was not provided for the platform to indicate:
a.  maximum load including personnel and merchandise
b.  weight of the platform
and;
Employees were exposed to amputation hazards while on the platform
from unguarded moving parts.
Feasible methods of abatement include but are not limited to the use of a
self-propelled, elevating work platform in accordance with the
requirements set forth in ANSI A92.6 or to consult with the manufacturer
to secure an approved and safe working platform that meets the
requirements of ASME B56.1-2000, Safety Standards for Low and High
Lift Trucks, Section 4.17 Elevating Personnel, and Section 7.36
