Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to the hazard of falling from an elevation while standing and working from a wooden pallet raised on the forks of a forklift truck: At the establishment: Employee(s) were retrieving and reviewing stock and stock code numbers while standing and working from a wooden pallet raised on the forks of a forklift truck. Among others, one feasible and acceptable method of abatement is the use of a commercially manufactured safety basket that is specifically designed for use on powered industrial trucks and meets the requirements of ANSI-ASME Standard B56.1-2000.
