29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a. On or about June 15, 2016 and at times prior, employees placed a safety basket, manufactured by Vestil Manufacturing Corporation, on the forks of a Yale forklift, model ERP040VFN36TE082, serial A955N02402M. The forklift manufacturer did not approve the use of the attachment, thereby exposing employees to fall and crushing hazards.

29 CFR 1910.303(g)(1): Space about electric equipment. Sufficient access and working space shall be provided and maintained about all electric equipment to permit ready and safe operation and maintenance of such equipment. a. Located in the battery charging area along the dock wall in the warehouse: On or about August 9, 2016 and at times prior, the access and working space in front of and below two electrical panels was obstructed by forklift battery chargers and a flexible conduit. b. Located on the wall adjacent to the cooler: On or about August 9, 2016 and at times prior, the access and working space in front of two electrical panels was obstructed by a metal guard rail and stored product.
