Minn. Stat. 182.653 subd. 2:  The employer did not furnish to each
employee, conditions of
employment and a place of employment free from recognized hazards which
caused or were
likely to cause death or serious injury to employees:
a.When the MDT Dumper is lowered from the elevated dumping position, the
operator's vision is obscured as the unit lowered back to the floor
position.  The
unit could potentially strike an employee who was passing by.
b.Product cars are rolled into a blender dumper and the unit is then
dumped into
the blender.  When the dumper is lowered back into the floor position, a
pinch
point is created.  The unit could strike an employee walking by.  The
control is
on the side of the unit, and the operator's vision is obscured as the unit
is
lowered.  Location:  Raw Further Processing Room.
