Title 40.1-51.1(a), Code of Virginia: The employer did not furnish employment, and a place of employment which were free from recognized hazards that were causing, or likely to cause death or serious physical harm to employees in that: an employee was exposed to tipping hazards while operating a scissor lift, when the operator drove into a 6 inch hole causing the lift to tip over. (a) One feasible and acceptable method of abatement among others to correct this hazard is to comply with the operators manual safety operating procedures found on pages 2-4, and 2-5, which states: Be aware of all conditions that could adversely effect the stability of the work platform. Operate the work platform only on firm surfaces. Do not position the work platform near holes or drop-offs and never drive it into holes, curbs, or other obstacles.
