Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by or caught in hazards associated with failure of air pressure to machines: In the Kohler Polish Area, side polish machines were operated with defective or missing safety lock cylinder mechanisms, exposing employees to hazards of being caught in pinch points or struck by the cylinder head in the event of a rapid drop or loss of air pressure. Machines operated with missing or defective safety lock cylinder mechanisms included the following: Instance a) In Kohler Polish Cell 4, machine serial number 8-2565-488. Instance b) In Kohler Polish Cell 4, machine serial number 4-594-1353-670-B- 74. Instance c) In Kohler Polish Cell 7, machine serial number 1-598-1482-679-B- 77. Instance d) In Kohler Polish Cell 7, machine serial number 7-1294-1362-670-B- 76. Among other methods, one feasible and acceptable means of abatement would be to repair defective safety lock cylinder mechanisms, replace missing safety lock cylinder mechanisms, and retrofit safety lock cylinder mechanisms on older machines that were never equipped with the mechanisms.
