Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the potential for accidental operation of the Piranha
Ironworker due to an
improperly guarded foot pedal:
(a)Shop area; The foot control pedal for the 90-ton Piranha Ironworker,
was
not
used in accordance with the acceptable requirements of the American
National
Standards Institute for Ironworkers ASME/ANSI B11.5-1998, Section 4.3.5, in
that the subject foot pedal was not adequately guarded above the foot pad,
and
also unguarded at the sides of the foot pad.
Among other methods, feasible and acceptable methods of abatement would be
to comply with American National Standards Institute for Ironworkers
ASME/ANSI B11.5, Section 4.3.5, which requires that a foot control shall be
protected so as to inhibit operation from falling or moving objects, or
unintended
operation by someone accidentally stepping on it.
