Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious harm to employees in
that employees
were exposed to fall hazards while using a scissors lift inconsistent with
the manufacturers
instructions to access a buildings roof.
(a)Keller, Inc., job site at 2507 Venture Dr., Eau Claire, WI:  An
employee was
observed climbing out of a Scissors lift (Genie GS-3268 RT, FABCO
RENTS), while in the process of installing rain gutters. Employee was not
utilizing fall protection, and was exposed to fall hazards of an estimated
20
feet to the dirt ground below.
Among other methods, feasible and acceptable methods of abatement to
correct this
hazard would be to comply with American National Standards Institute
(ANSI) A92.6-
2006, standard for Self-Propelled Elevating Work Platforms, which requires
in section
7.10(9) that personnel shall maintain a firm footing on the platform floor
while
working thereon.
