Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees
working on the top of railcars were exposed to fall hazards that could
lead to death or permanent
disability.
(a)On August 3, 2004 employees were exposed to fall hazards of more that
12 feet
from the top of railcars while taking samples of incoming product, and the
employer did not provide proper fall protection.  One feasible and
acceptable
means of abatement would be to install and require the use of personal
fall arrest
system while employees are on top of the railcar.
IN THE ALTERNATIVE
29 CFR 1910.132(a): Personal protective equipment was not provided when
necessary by reason
of hazards of processes or environment capable of causing injury or
impairment.
(a)On August 3, 2004 employees were exposed to fall hazards of more then
12 feet
from the top of railcars while taking samples of incoming product, and the
employer did not provide proper fall protection.
Certification, with date and method of abatement required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
