Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of a fire which occurs when sparks form and ignite at the cutter or form and move into the dust collection system where the Class II dust is ignited, on or about November 9, 2005. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS to install a spark extinguishing system in accordance with NFPA 69, Chapter 6, Spark Extinguishing Systems, to detect and extinguish sparks or embers as they pass through ducts that transport the combustible dust.
