Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries: At Cargo Dock 15, at the Port of Brownsville,Texas on 12/09/03, the employer did not ensure that the operator(s) carry out the duties as required by the Manitowoc Service Manual for the Manitowoc 3900T Crane S.N.39917 in that the operator did not consult with the person supervising the lift when the safety of the operation was in doubt. Among other methods, one feasible and acceptable method of correction is to have all crane operators comply with the requirements of the Manitowoc 3900T Service Manual.
