Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees exposed to a 13 foot fall: Union Tank Car - Marion, Ohio: On January 30, 2004, employees were exposed to an approximate fall distance of 13 feet while standing on a tank car work platform in the yard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install and maintain a gangway, loading platform, safety enclosure, mobile platform, or provide a personnal fall arrest system for employee use while on top of the tank cars. Additional abatement information is required for this item.
