Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that:
a)  Union Tank Car Company - Marion, Ohio:  On or about October 14,
2004 the employer failed to ensure that employees working at the
cleaning rack were protected from inhalation and dermal exposure
from the liquid discharged from the flare (John Zink Company - STF-
S-6) during the cleaning of a tank car (UTLX 901367). The tank car
previously contained a chemical mixture that included methyl
methacrylate and ethyl acrylate.
One feasible means of abating this hazard is to install a knockout
drum meeting the criteria in American Petroleum Institue 521 -
Guide for Pressure-Relieving and Depressuring Systems (March 1997),
Section 5.4.2, to ensure that liquid entrained in the vapor/gas
mixture from the tank car, as well as residual condensate in the
vent line, are removed prior to being discharged to the flare
assembly.
In accordance with 29 CFR 1903.19(d), abatement certification is
required for this violation (using the CERTIFICATION OF CORRECTIVE
ACTION WORKSHEET), and in addition, documentation demonstrating
that abatement is complete must be included with your
certification.  This documentation may include, but is not limited
to, evidence of the purchase or repair of the equipment,
photographic or video evidence of abatement, or other written
records.t,
