Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were likely to cause death or serious physical harm to employees in that
an employee was
exposed to tipping and/or crushing hazards while directing dump trucks.
a.  On or about August 29, 2005 at the Ohio State Route 53 project,,
Fremont, Ohio:  An
employee was standing between, and directing dump trucks on a road project
when one of the
dump trucks tipped onto an adjacent truck nearly missing the employee and
killing the driver in
the adjacent truck.
Some feasible and acceptable abatement methods to correct this hazard are:
-  Never dump side-by-side.
-  Keep dump trucks at least two truck lengths apart.
-  Be alert for material stuck in truck bed as this may cause instability.
-  Ensure personnel and/or equipment  are clear before dumping.
-  Ensure that the ground is firm and level prior to dumping.
- Consider using straight trucks instead of long dump trailers, where
appropriate, due to
surface conditions.
-  Where aggregates are being spread, consider using belly dump trailers.
