Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:

that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to fall hazards while being lifted on a forklift
truck with an
unapproved personnel lift platform:
a)In the back warehouse and storage area, employees were walking and
working on a
wooden platform twelve (12) feet above the concrete floor below without
utilizing any
type of fall protection. Employees were lifted up by a walk behind
forklift to retrieve
boxes and furniture from the shelves above. The wooden platform was
positioned
between the two forks located on the walk behind forklift.
While ultimate responsibility for correcting the hazard rests with the
employer, given his/her
superior knowledge of the work place, feasible and acceptable methods to
correct this
hazard, among others are:
(1) Follow guidelines listed in the American Society of Mechanical
Engineers (ASME)
B56.1-2000, Safety Standard for Powered Industrial Trucks, section 4.17 -
Elevating
Personnel - with a High Lift Truck designed to elevate personnel, and
section 7.36 -
Platforms - Elevating - providing the restraining means such as railing,
chains, cable. body
belt(s) with lanyard(s), or deceleration devices, that are in place and
properly used.
(2) Follow guidelines listed in the American National Standards Institute
(ANSI) A64.1,
Requirements for Powered Industrial Trucks, ANSI B56.1-1969, was one of
the national
consensus standards that OSHA adopted. This ANSI standard was the source
standard for
OSHA's Powered Industrial Trucks Standard. Paragraph (m)(12) of CFR
1910.178, as it was
published in May 1971 and as it still appears today, reads as follows:
Whenever a truck is
equipped with verticle only, or vertical and horizontal controls
elevatable with the lifting
carriage or forks for lifting personnel, the following additional
precautions shall be taken for
the protection of personnel being elevated. (i) Use of a safety platform
firmly secured to the
lifting carriage and/or forks. (ii) Means shall be provided whereby
personnel on the platform
can shut off power to the truck. (iii) Such protection from falling
objects as indicated
necessary by the operating conditions shall be provided.
Abatement verification is required for this violation. The abatement
certification sheet
is enclosed with the citation(s).
