Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by overturning equipment. On or about 5/6/4, in front of the Fort Lauderdale airport, Terminal 2, an employee was exposed to being struck by an overturning Komat'su PC220LC-7 excavator while operating it because the employer did not require the use of an operator restraint device. Among other methods, one feasible and acceptable abatement method to correct the hazard is requiring the use of seatbelts. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS NOT REQUIRED FOR THIS VIOLATION.
