Section 5(a)(1) of the Occupational safety and Health Act of 1970:  the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees:
a. On or about June 24, 2004 - at the above addressed jobsite, an employee
performing concrete
formwork from a Skyjack, Model SJ 9250, scissors lift was exposed to
injuries from falls
created by the improper use of the elevated work platform.  The employee
was standing on the
mid rail of the lift.  One feasible and acceptable abatement method, among
others, to correct the
hazard would be to comply with the American National Standards Institute
(ANSI) A92.6-1999
Self-Propelled Elevating Work Platforms which requires workers to maintain
firm footing on the
platform floor while working thereon and states that climbing by occupants
on the midrail or
toprail of the aerial platform is prohibited, and/or the Equipment
Manufacturers Institute (EMI)
Safety Manual for Aerial Platforms which states "do not lean over or sit
or
climb on the
platform railing.  Always keep both feet on the platform floor at all
times."m
