Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck and/or crushed into
the between trailer
and rail car.
On or about August 6, 2004, employees were exposed to the hazards of being
struck by a
trailer suspended by a crane.  The trailer started to swing during the
process of raising the
trailer enough to have the groundman raise the front legs (dollys and
shoes) to clear the rail
car.  The suspended trailer started to swing and struck the groundman
between the trailer and
rail car.
One feasible and acceptable abatement method, among others, to correct
this hazard is to use
the proper procedure of lifting the trailer front legs (dollys and shoes)
only.
Using hand and
radio communication signal between crane operator and groundman with
adequate training,
follow up  training and enforcement for all employees crane operators and
groundmen.  As
referenced by the CSX Railroad related to the  FC/COFC operating
procedures for loading
and unloading quality terminal service, safety rules and MI-jack translift
crane operators
manual are to be used for training crane operators and groundmen.
Note:  29 CFR 1903.19 requires that you provide certification and
documentation of
abatement for this item.
