Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to fall hazards while working on
the railcars:
(a)At the site - employees were exposed to an approximate 13 foot fall
hazard while
installing bridge plates between rail cars, on or about 2/8/05.
(b)At the site - employees were exposed to an approximate 13 foot fall
hazard when
accessing the "B" deck via the ladders attached to the railcars, on or
about 2/8/05.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to provide and require the use of fall protection equipment to
employees when
they're exposed to these fall hazards.

exposed to fall hazards were working in areas with poor illumination:
(a)At the site in the rail yard, the employer did not provide adequate
lighting for
employees loading/unloading automobiles from railcars; measurements taken
in
all areas of the railcar with an Extech light meter registered lighting
levels of 0
footcandles. This inadequate lighting condition would impact the employees'
ability to judge their location in relation to the open-sided ends of the
railcars,
increasing the potential for the employees to fall from the 13 foot high
upper level
from which they work.
Among other methods, one feasible and acceptable method to correct this
hazard
is to provide additional lighting for the interior spaces of the railcars
(e.g., use
of portable tiered lighting - a light system that has three lights located
at different
levels).  Figure 9-80 of the IES (Illuminating Engineering Society)
Lighting
Handbook recommends that freight car interiors have a lighting level of at
least
10 footcandles.
