P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling down an elevator shaft or being struck by a falling material platform: A) Resin Plant - Employees were unloading material from an elevated platform positioned in an elevator shaft that was not properly seated in the "saddle" or "bowl" of the hook of a two ton Yale hoist. A feasible and acceptable abatement method to correct this hazard is to ensure that employees are re-trained to properly inspect the overhead hoist, including the hook, to ensure that the load is properly seated in the "saddle" of the hook in accordance with ASME B30.16-1998 section 16-3.1.2.
