P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of combustion, explosion, and fire hazard: a)Back of Package Boiler (Platform Area) - On or about January 21, 2009, a natural gas vent was installed close the floor of a leased package boiler platform exposing employees to combustion, explosion, and fire hazards. A feasible means of abatement would be to construct a natural gas vent in accordance with NFPA 85, Boiler and Combustion Systems Hazards Code 2007 edition, where the natural gas discharge area is above and/or away from areas where employees work and/or where ignition sources could be present.
