North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being caught between the fork lift and the ground in the area where the load of bricks was being off-loaded in the event of the fork lift being upset or turned over. The employee was not wearing the seat belt that was provided. Among other methods, one feasible and acceptable abatement method would be to properly train all fork lift operators in the use of seat belts and to require seat belts to be worn whenever they are operating a fork lift that is equipped with a roll over structure. The exposed employee was not wearing the seat belt and the fork lift was equipped with a roll-over structure. Reference: ASME B56.1-1993 - Safety Standards for Low Lift and High Lift Trucks and the operator's manual for the MOFFETT MOUNTY fork lift.
