Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about September 21, 2005, and times prior to, employees entered into a 6-foot diameter water pipe, for the purpose of construction, without assuring that air monitoring was performed, a common communication system was in place in case of emergency, an attendant remained outside the confined space, and a permit system in place. Among other methods, recognized and feasible means of abatement to correct the hazard include, but are not limited to: a) Full implementation of the elements required by the American National Standards Institute (ANSI) Standard Z117.1 (Safety Requirements for Confined Space). b) Implementation of the elements outlined in the National Utility Contractors Association (NUCA) Confined Space Entry Manual.
