Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to electrical shock, caught in, struck by and fire hazards:
(a)F/T Defender: Employees exposed to electrical shock, fire, struck by,
and caught in
hazards by the employer not developing a written lockout/tagout (LO/TO)
program for
hazards in the workplace, to include (1) periodic inspection of the LO/TO
energy control
procedures (2) engineering equipment specific procedural steps for, but
not limited to,
the scope, purpose, authorization, rules, and techniques for the control
of hazardous
energy (3) release from  LO/TO (4) shift or personnel changes, and (5)
work performed
on the vessel by outside personnel and contractors.
(b)F/T Defender: Employees exposed to struck by, caught in, and electrical
shock
hazards
by a Tokai Header (model PHC550L on machine #135) that was observed to be
disassembled for maintenance and energized by the main power source
without any
means of lockout and or tagout for the machine's controls and stored
energy sources.
(c)F/T Defender: Employees exposed to struck by, caught in, fire, and
electrical shock
hazards by the employer not providing a complete inventory of
lockout/tagout (hardware)
devices for the vessel's circuit breakers to isolate and secure hazardous
energy sources
for which the unexpected energization or start up of the machines or
equipment, or
release of stored energy, could cause injury to employees.
(d)F/T Defender: Employees exposed to struck by, caught in, and electrical
shock hazards
by the employer not providing adequate lockout/tagout (LO/TO) training to
the Factory
Processing Personnel for the employer's LO/TO program and procedures to
follow for
hazardous energy sources in their workplace, for which the unexpected
energization or
start up of the machines or equipment, or release of stored energy could
cause injury to
them.
NOTE: Among other methods, one feasible and acceptable method to correct
the hazards
is to develop and implement the vessel's written LO/TO procedures,
equipment, and
employee training in accordance with the U.S. Code of Federal Regulations,
Title 29,
part 1910.147,"The Control of Hazardous Energy (Lockout/Tagout)."
(e)F/T Defender: Employees exposed to electrical shock and burn hazards
from their
operating an electrically powered Bosch vertical portable grinder, model
number 1347A,
with a four and one-half inch abrasive wheel, that was observed to have
damaged (torn)
insulation on the power cord that exposed the underlying conductors.
(f)F/T Defender: Employees exposed to electrical shock and burn hazards
from
their
operating an electrically powered Milwaukee vertical portable grinder,
model number
6140, with a four and one-half inch abrasive wheel that was observed to
have damaged
(torn) insulation on the power cord that exposed the underlying conductors.
NOTE: Among other methods, one feasible and acceptable method to correct
the hazards
is to replace the damaged flexible power cords on the grinders.
