Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: Walden Point Road Station #1: On or about May 9, 2008 and at times prior thereto, employees were exposed to struck-by hazards from construction vehicle traffic (earthmoving equipment) while directing the placement of overburden. Among other methods, one feasible and acceptable method to correct the hazard includes providing exposed employees with hi-visibility clothing which meets the requirements of the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition-December 2000.
