Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Starboard Weather Deck: On or about July 15, 2009 and times prior thereto, employees were being lifted in a Billy Pugh personnel transfer device between the Tramper vessel and the M/V Ocean Fresh without personal flotation devices (PFD), tag line and no positive locking device on the crane hook. This exposed employees to fall and drowning hazards. Among other methods, feasible means of abatement would be to follow manufacturers recommended use and memorandum on the use of Billy Pugh personnel transfer device in the fishing and fish processing industry.
