Nevada Revised Statute 618.375(1): The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer failed to ensure that the employee utilizing the JLG Scissor Lift (Model #CM- 2033, Serial #0200014984) was trained to operate the lift and failed to ensure that annual and frequent maintenance was performed on the scissors lift, as follows: a.On the east side of the Bally's Convention Center, an employee was operating the JLG Scissor Lift and had not been trained. The lift had not had an annual or frequent inspection since 1999. Reference: ANSI A92.6-1990/7.3.1 and 7.3.2 Frequent (quarterly), and annual inspections shall be performed on this equipment. ANSI A92.6-1990/7.6 Whenever an user directs or authorizes an individual to operate an aerial platform the user shall ensure that the individual has been trained in accordance with the manufacturer's operators and maintenance manual, the user's work instructions, and the requirements listed in Section 8 of this standard before operating the platform. One feasible and acceptable abatement method is to ensure that employees are trained prior to operating this equipment, and proper maintenance is done on equipment in accordance with ANSI A92.6-1990.
