Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed and/or struck-by the loader bucket of a Caterpillar 446B, Backhoe Loader: a)On or about 06/27/2005 - Corner of Reeves Avenue & 146th Place An employee unloading equipment from the raised loader bucket of a Caterpillar 446B Backhoe Loader was exposed to a crushed-by and/or struck-by hazard. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO: 1. Follow safe operating procedures as outlined in the Caterpillar Operation & Maintenance Manual, 446B Backhoe Loader; page 48,Stopping the Machine, 6."Lower all raised attachments to the ground. Apply a slight down pressure."; and page 50,Loader Operation,"Do not operate the loader unless you are in the operator's seat facing forward, (toward the loader) unless you are following instructions in the topic "Moving Machine Forward During Backhoe Operation." ABATEMENT VERIFICATION IS NOT REQUIRED.ION
