Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to being crushed by back hoe. a)On site. Employees were exposed to being crushed by back hoe because workers were not clear of the back hoe during operation, on or about 9/22/05. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS: to follow the manufacturer`s manual Page 20, "Before Operation" clear all personnel from the machine and from the area, and Page 15-16 "Crushing Prevention" Stay clear of areas that may have a sudden change in clearance. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION AND DOCUMENTATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19NCE
