5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer
did not furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees
were exposed to the hazard of being caught in between:
a)Workplace - On or about June 26, 2005, an employee operating a
Philadelphia
Tramrail Company vertical downstroke baler, Serial No. 2300 was exposed to
injury by being caught in the ejector chains while attempting to manually
manipulate the chains where they had gotten stuck.  The chains had been
previously shortened during an unauthorized modification of the equipment
and
the employee was not trained in the methods of operating the baler safely.
ABATEMENT NOTES:
Among other methods, one feasible method to reduce this hazard is to:
1.Replace the baler ejector chains with new authorized chains per page 21
of the Parts and Service Manual which states "We strongly recommend
that all replacement parts be identical to the original components."
2.Train all operators in the safe operation of the baler in accordance with
ANSI Z245.5-1997, 7.1c.
ABATEMENT DOCUMENTATION IS NOT REQUIRED AS OUTLINED IN PART 29
CFR 1903.19.
