Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to fall and crushing hazards while working from a platform
elevated by a rough terrain
forklift:
a)Warehouse: Two employees were observed working from an unsecured
platform on the
forks of a Lull #824B rough terrain forklift. One employee was welding
from inside the
platform as the other employee sat on the guard rail of the elevated
platform. The
employees were exposed to a 12 foot fall hazard to the concrete surface
below.
ABATEMENT NOTE:
Among other method a feasible and acceptable means to correct this hazard
is
to use a platform
approved by the manufacturer, meeting the design, manufacture and use
requirements of ASME
B56.6-2002 for all attachments on rough terrain forklifts.  ASME
B56.6-2002 requires the
following:
5.15.1A rough terrain forklift shall not be used to lift people unless
there is no other
practical option.
If a rough terrain forklift must be used to lift people, the following
precautions shall be taken:
5.15.1(b)be certain that the platform is securely attached to the lifting
carriage and forks.
5.15.1(u) personnel are to maintain firm footing on platform floor unless
secured by body
belt and lanyard.
Abatement Certification and Abatement Documentation required.
