Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injuries from the improper use of personal protective equipment for falls, i.e. body harness and lanyard. (a) An employee working as a cycle counter on a high lift (cherry picker) in the warehouse did not receive training and instructions on the use and adjustment of a body harness and lanyard issued to the employee for fall protection. One feasible means of abatement would be to provide training in the proper use of the equipment. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
