North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and a
place of employment free from recognized hazards that were causing or
likely to cause death or
serious physical harm to employees, in that employees were exposed to
contact with electricity
which could result in electrocution:
Conductors were not spliced or joined with splicing devices identified for
the use or by brazing,
welding, or soldering with a fusible metal or alloy. All splices and
joints and free ends of
conductors were not covered with an insulation equivalent to that of the
conductors or with an
insulating device identified for the purpose [NEC 110-14(b)];
Direct buried conductors and cables emerging from the ground were not
protected by enclosures
or raceways extending from the minimum cover distance required by Section
300-5(a) below
grade to a point at least 8 ft. above finished grade. Where the enclosure
or raceway is subject to
physical damage, the conductors were not installed in rigid metal conduit,
intermediate metal
conduit, Schedule 80 rigid non metallic conduit, or equivalent [NEC
300-5(d)];
200 ft., Type NM-B, 10-3 wire cord was use as service-entrance cable
[336-5(a)(2)]:
a)Southeast corner of building, base of scaffold, near down spout clean
out - 200 ft.,
110 volt, 40 amp, Type NM-B, 10-3 wire cord, partially buried underground,
supplying power to temporary power panel in building, from main power pole
near
job trailer, 200 feet away, was being used as service-entrance cable, and
spliced
with wire nuts and black electrician tape.
One feasible and acceptable method of abatement, among others, to correct
this hazard is to
replace this Type NM-B, 10-3 cord, being used as a service-entrance cable,
with a Type SE or
USE cable, and protect it from damage by enclosing it in some type of
rigid conduit.
