Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe burn injuries from the potential dust explosion hazard that could have resulted from, or been exacerbated by the location of the dust collectors indoors in a Class II, Division 1 area, the use of non-conductive and corrugated flexible ductwork, and the lack of daily cleaning of the collection system. a.)Sanding Area- Employees sanded aluminum parts using two (2) Hammond Variable Speed Polishing and Buffing Lathes and collected the dust using two (2) Hammond DK-855 Cyclone DusKolector dust collectors, model 855-B, serial numbers 16466 and 12980. They were not located outside the building, nor were barriers located between the dust collector and personnel. The flexible ductwork was not constructed of a nonconductive material with a smooth interior, but rather was corrugated and conductive. The dust collector was not designed by the manufacturer to be used for aluminum dust. Dust was not removed from the dust collectors on a daily basis. Exhaust air from the dust collector was recycled back into the building, on or about 3-9-05. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method includes, following National Fire Protection Association 484, "Standard for Combustible Metals, Metal Powders and Metal Dusts, 2002 Edition. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
