Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of potential explosion while using job made heaters: a) At the site, in the covered welding area, employees were using job made heaters. These heaters operate using natural gas. The gas supply lines, from the gas cut off to the heater, consisted of rubber tubes. These tubes are not U.L. approved for use as a natural gas supply line, thus exposing employee to the potential natural gas leaks and possible explosion. Also the job made heaters had no regulators installed or other means to control the gas/ air mixture, thus potentially exposing employee to carbon monoxide. The heater enclosure, a 55 gallon metal drum, exposed the employees to burns due to the proximity to the aisle. Among other methods, one feasible and acceptable abatement method to correct the hazard would be to purchase heaters and installation hardware approved by a nationally recognized testing laboratory.
