Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by moving equipment, trucks and forklifts:: The employer violated this obligation on or about November 1, 2005, at this site where a Traverse Lift Model F-644 all terrain forklift was operating with a non-functional backup alarm. Personnel working behind the forklift were not visible to the operator while the forklift was backing, and no spotter was used. Among other methods, feasible and acceptable means to abate this hazard include, but are not Engineers (ASME) B56.6-1992, Safety Standard for Rough Terrain Forklift Trucks Paragraphs 5.13.2 and 7.2.6.
