Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the caught-in hazard due to unexpected release of hazardous energy: On October 12, 2004 and at other times prior thereto, at this well site, employees were allowed to work under suspended rig derrick parts without ensuring all potential energy had been secured/controlled before beginning modification work. The employer did not ensure the control of hazardous potential energy prior to allowing work in accordance with its written safety and health program. Among other methods, one feasible and acceptable method to correct this hazard is to implement and enforce a policy that involves physically and positively securing all equipment that has the potential of releasing energy (potential) prior to allowing any employee to work on that equipment.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from improperly installed clips: On October 12, 2004 and other times prior thereto, at this well site, employees were allowed to work in and around an A-frame truck where Crosby clips were not properly installed and adequately secured, exposing employees to being struck by unexpectedly moving equipment and parts. Among other methods, one feasible and acceptable method to correct this hazard would be to install Crosby clips in accordance with the manufacturer-provided instructions.
