OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by high pressure oil, mud, and sludge from a blow-out.    On November 11, 2015, on Rig Arrow 10, the remote koomey control was non-functional in that the accumulator controls to the BOP was not connected to the secondary panel on the rig floor.

In between water pumps #1,#2 and the water tanks.    B.)  Adjacent to the water tank.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.    On November 11, 2015, and times prior there to, on Rig Arrow 10, adjacent to the Blowout Preventer and underneath the rig floor, employees worked from a temporary platform deck without adequate fall protection.  Employees were exposed to a fall more than 20 feet below.

Where employees provide their own protective equipment, the employer shall be responsible to assure its adequacy, including proper maintenance, and sanitation of such equipment.    On November 11, 2015, on Rig Arrow 10, the employer failed to provide and ensure the use of flame-retardant treated clothing (FRC) necessary to protect employees from burns due to potential flash fires during swabbing operations.
