Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)Worksite located at 8700 Hawthorn Road, Kansas City, Missouri, Silo 5B
Recycle Ash.  On or about May 13, 2005, employees were exposed to hazards
such as but not limited to engulfment, falls, overexposure to dusts, eye,
nose and
throat irritation. Employees were asked to open the hatch on the pipe
feeding the
recycle slurry tank in order to free the blockage and vacuum out the
contents of
the silo when the fly ash spilled out uncontrollably.
Among other methods, one feasible and acceptable abatement methods to
correct this hazard is
the engineering of direct connections to the silo bins so that employees
would not be required
to open the hatches located on the pipe feeding from the fly ash silo to
the slurry tank.
