Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Employees risk of getting burned or killed during aircraft firefighting and rescuing of passengers operations is highly incremented due to the fact that the Luis Munoz Marin Airport Rescue Unit was severly understaffed in some shifts with less than half the employees needed to perform the firefigthing and rescue operations as required under NFPA 403 Standard as a result the chance of an aircraft fire getting uncontrolled is incremented. NFPA 403 paragraph 8.1.2.2.(B)) read as follow: "Under no circunstances shall the minimun required staffing be less than those values appearing in Table 8.1.2.1". The Airport Rescue and Fire Figthing (ARFF) Unit at Luis Munoz Marin Unit had 5 fire fighters assigned in some of the shits on July-2006 roster (see copy of roster on file). The Luis Munoz Marin Airport is characterized as category eigth (8) under NFPA 403 Table 4.3.1. The minimun staff required by NFPA 403 Table 8.1.2.1 is 12 ARFF personnel per shift readibly available. The Luis Munoz Marin Airport is considered category eight (8), the number of personnel required is twelve (12) ARFF personnel. Table A.8.1.2 read as follow: " The minimun total number of trained personnel responding should be based on the equivalent of 3 per ARFF vehicle. Additionally an Incident Commander and 2 trained personnel for Rapid Intervention". The employer had knowledge of the requirements stablished on NFPA 403, also there is evidence on this case that sustains that supervisory staff had requested more personnel to the management. The principal objective of a rescue and fire-fighting service is to save lives - NFPA 403 paragraph 1.2.2. While ARFF personnel is saving lives during aircraft rescue missions, they are exposing themselves to harm and not having sufficient personnel to attend the airport emergencies increment the risk involved in the fire control and rescue operations. Among other methods, one feasible and acceptable method to correct this hazard is to provide the ARFF unit with 12 persons fully trained and readibly available per work shift as the NFPA 403 requires. Empleados en riesgo de quemarse o morir durante operaciones de combatir fuego de aviones y rescate de pasajeros debido a que en el en el Aeropuerto Interncaional Luis Munoz Marin. La unidad de rescate aereo esta severamente restrigida por tener en algunos turnos menos de la mitad de los empleados que se requieren y se necesitan como lo establece el reglamento NFPA 403, como resultado de lo antes expuesto la probabilidad se incrementa de que un incendio en una nave se descontrole. El reglamento NFPA 403 parrafo 8.1.2.2.(B)) lee y cito: "Bajo ninguna circunstancia la cantidad minima de personal puede estar por debajo de los valores queaparecen en la tabla 8.1.2.1". La Unidad de Rescate y Combatir-Fuego (ARFF por sus siglas en ingles) tenia 5 bomberos asignados en algunos de los turnos de la agenda de turnos de julio- 2006 (ver copia incluida en expediente). El aeropuerto Luis Munoz Marin esta caracterizado como categoria ocho (8) bajo el reglamento NFPA 403 Tabla 4.3.1. La cantidad minima de personal requerido en reglamento NFPA 403 Tabla 8.1.2.1 es 12 bomberos ARFF por turno que esten disponibles al momento. Reglamento NFPA 403 paragraph 8.1.2.2.(B) lee y cito; "Bajo ninguna circunstancia la cantidad minima de personal puede estar por debajo de los valores que aparecen en la tabla 8.1.2.1". El Aeropuerto Internacional Luis Munoz Marin esta considerado como categoria ocho (8) y el numero de persnal requerido es doce (12) bomberos ARFF. Tabla A.8.1.2 lee como sigue: "El total minimo de personal adiestrado de respuesta se basara en el equivalente de 3 por cada vehiculo ARFF. En adicion tendran un Comandante de Incidente y dos empleados adiestrados para Intervenciones Rapidas". El patrono tenian conocimiento de los requisitos establecidos por el reglamento NFPA 403, en adicion hay evidencia en este caso que sustenta que los supervisores solicitaron mas personal a la alta gerencia. El objetivo principal de una Unidad de Rescate Aereo y combatir fuego es salvar vidas - NFPA 403 paragraph 1.2.2. Mientras personal ARFF se encuentren salvado vidas durante misiones de rescate en aviones, ellos se esxponen a dano y al no tener el personal suficiente para atender las emergencias el riesgo envuelto en operaciones de controlar fuego y rescate se incrementa. Entre otros metodos, uno factible y aceptable para corregir este riesgo es proveer 12 empleados totalmente adiestrados y disponibles al momento por cada turno de trabajo como se el NFPA 403 lo requiere.
