Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm in that employees were exposed to the
hazard of potential fire and  explosion
because methods were not utilized to contain combustible, organic dusts
created by manufacturing, handling,
and processing operations from becoming airborne and combining with an
ignition source:
a)  Stearate Area, L2 Room - On or about January 13, 2006 bagger room
equipment including
material hopper and auger-packer were not maintained under continuous
suction thus allowing the
escape of dust during normal operations.
b)  Stearate Area, L3 Room - On or about January 13, 2006  equipment in
this area including material
hopper and auger-packer were not maintained under continuous suction to
minimize the escape of dust
during normal operations.
c)  Flaker Area - On or about March 21, 2006 The product discharge area of
the flaker machine was
not maintained under constant suction to minimize the escape of dust
during normal operations
d)  Slab-Dip Area - On or about March 21, 2006 the Slab-Dip Area Large
mixing vat was not
maintained under continuous suction to minimize the escape of dust during
normal operations.
Among other feasible methods one method to abate these hazards would be to
ensure that organic
powder processing areas of machinery are kept under negative pressure to
the surrounding areas.
Abatement certification and documentation required within 10 days after
abatement date.  The
certification shall include a statement that abatement is complete, the
date and method of abatement,
and state that employees and their representatives were informed of this
abatement.  Abatement
documentation shall include documents demonstrating that abatement is
complete, such as evidence of
the purchase or repair of equipment, photographic or video evidence of
abatement or other written
records.

fixed bulk storage units and air-material separators (dust collectors)
were not designed to minimize damage
that would occur in the event of a dust explosion inside the machines:
a)  Stearate Area, L2 Room - On or about January 13, 2006 bagger room
product hopper was located
inside the building and did not meet the protection, venting or size
requirements for inside bulk
storage.
b)  Stearate Area, L3 Room - On or about January 13, 2006 room product
hopper on the bagger
system was located inside the building and did not meet the protection,
venting or size requirements
for inside bulk storage.
c)  Flaker Area - On or about March 21, 2006  air-material separator was
not located outside of the
building or provided with explosion venting to the outside or equipped
with an explosion suppression
system.
d)  Slab-Dip Area - On or about March 21, 2006  air-material separators
were not located outside of
the building or provided with explosion venting to the outside or
explosion suppression systems.
Among other feasible methods on method to abate these hazards would be to
ensure that organic
powder processing areas comply with all the requirement of NFPA 654.  Bulk
storage and air material
separators should be located outside or provided with systems or devices
to protect employees from
any explosions which may occur in this equipment.
Abatement certification and documentation required within 10 days after
abatement date.  The
certification shall include a statement that abatement is complete, the
date and method of abatement,
and state that employees and their representatives were informed of this
abatement.  Abatement
documentation shall include documents demonstrating that abatement is
complete, such as evidence of
the purchase or repair of equipment, photographic or video evidence of
abatement or other written
records.

because metal materials are allowed to enter into milling machines
creating the potential for the grinding of the
metal to produce sparks, leading to a dust explosion inside the machines:
a)  Stearate Area, L2 Room - On or about January 13, 2006 foreign
materials were not excluded or
removed before material is processed by size reduction equipment.
b)  Stearate Area, L3 Room - On or about January 13, 2006 foreign
materials were not excluded or
removed before material is processed by size reduction equipment.
Among other feasible methods one method to abate these hazards would be to
ensure that foreign
materials are removed by grates or other separation devices.
Abatement certification and documentation required within 10 days after
abatement date.  The
certification shall include a statement that abatement is complete, the
date and method of abatement,
and state that employees and their representatives were informed of this
abatement.  Abatement
documentation shall include documents demonstrating that abatement is
complete, such as evidence of
the purchase or repair of equipment, photographic or video evidence of
abatement or other written
records.

employees
in that employees
were exposed to potential fire and explosion hazard from the improper
storage of chemicals:
a) Laboratory - Employees were exposed to fire/explosion hazards from the
improper
storage of chemicals.   Hydrochloric and sulfuric acids where stored with
the organic
solvent toluene underneath the laboratory hood.   The chemicals can react
together giving
off heat and flammable vapors on or about March 9, 2006.
b) Main Warehouse - Employees were exposed to fire/explosion hazard from
the
improper storage of chemicals.  A  55 gallon drum of Glacial Acetic Acid
was stored
along side of a drum of combustible corrosive dicyclohexylamine.  These
chemicals are
incompatible and would create heat and flammable vapors if mixed  on or
about March
9, 2006.
c) Main Warehouse - Employees were exposed to fire/explosion hazards from
the
improper storage of Chemicals.  A 55 gallon drum of 45Caustic Potash was
stored
along side of a drum of Glycol Ether EB.  These chemicals are incompatible
and create
heat and chemical vapor if mixed  on or about March 9, 2006.
Abatement certification required within 10 days after abatement date.  The
certification shall
include a statement that abatement is complete, date and method of
abatement, and states
employees and their representatives were informed of this abatement.
