North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to the hazard of being crushed:
a)Bay 2 - an employee was rolling the I-beam in order to
weld the bottom wing plate onto the beam.  While the
employee was moving an alloy chain sling and hook away
from the beam, the hook did not clear the I-beam causing
the beam to fall onto the employee; thereby, causing a
fatality.
Feasible Abatement: Abatement may include but not be
limited to the employer administratively evaluating the
work practices of the task.  For example, instead of
employees standing in front of the beam while controlling
the hoist and crane they can stand at one end of the
beam.  This new position gives the employees a clear view
of the hoist and chain.  In the event of the alloy chain
sling or hook causing the beam to fall, the employees
likelihood of being in danger of being struck by the
falling I-Beam would be minimal.
